2 SAC-ANTI THEFT 08-2020 DEFINITIONS COMMERCIAL USE – A Commercial Use Vehicle is defined as a vehicle registered to a business and/or for business purposes. Vehicles that are used in excess of manufacturers G.V.W. Vehicles used for construction purposes, delivery purposes, commercial towing, commercial farm operation, tow trucks, snowplows any type of emergency vehicles, volunteer public service(s), motor pool vehicles, rental, taxi cabs, livery or for excessive hauling and pulling are excluded from coverage hereunder. (This does not include rideshare i.e. Uber or Lyft.) VEHICLE PROTECTION PRODUCT WARRANTY HOLDER (YOU, YOUR) – The purchaser of this Anti-Theft Vehicle Protection Product Warranty. VEHICLE PROTECTION PRODUCT WARRANTY (VPP) – This Anti-Theft Vehicle Protection Product Warranty for the Vehicle described on the Schedule Page. SCHEDULE PAGE – The numbered document which is part of this Vehicle Protection Product Warranty where information regarding You, Your Vehicle and coverage options are shown. SELLER – The dealership from whom You purchased this Vehicle Protection Product Warranty. TERM – The maximum number of months indicated on the Schedule Page that this Vehicle Protection Product Warranty shall be in force. VEHICLE – The Vehicle covered by the terms and conditions of this Vehicle Protection Product Warranty as listed on the Schedule Page. WARRANTOR, ADMINISTRATOR, WE, US, AND OUR (OBLIGOR) – SMART AUTOCARE, P.O. A. COVERAGE AND CONDITIONS COVERAGES In the event the Theft Deterrent System installed on the Vehicle specified in this Vehicle Protection Product Warranty fails to prevent the Vehicle from being stolen and recovered within thirty (30) days, and in the event the Vehicle is rendered a total loss as a direct result of that theft, as defined by the Your primary comprehensive insurance company, the Warrantor agrees to pay the selected benefit amount indicated on the Schedule Page or the actual cash value of the Vehicle, whichever is less. This Vehicle Protection Product Warranty commences on the Vehicle Protection Product Warranty product purchase date and expires when the selected Term has elapsed. During the selected Term of this Vehicle Protection Product Warranty You must maintain comprehensive automobile insurance coverage on the Vehicle at least equal to the actual cash value of the Vehicle. Failure to do so will VOID this Vehicle Protection Product Warranty. B. HOW TO FILE A CLAIM In the event Your Vehicle is stolen and not recovered within thirty (30) days, You need to contact the Administrator at (855) 292-9309 to report Your loss. Claim must be reported within forty-five (45) days of theft. You must be able to provide Us with a copy of this signed Vehicle Protection Product Warranty, a copy of the police report, and a copy of Your primary insurance company’s settlement check. No benefit will be paid until the insurance company settlement is finalized. We would like to contact You regarding the status and progress of Your claim via a text message. During Your initial claim contact with the Administrator, You will be asked to confirm Your acceptance of receiving text messages. You can opt-out of receiving text messages at any time by contacting the Administrator at (855) 292-9309 or “Text STOP to end.” C. EXCLUSIONS - WHAT IS NOT COVERED CONDITIONS NOT COVERED This Vehicle Protection Product Warranty does NOT provide coverage for any of the following: 1) Theft by any person who had access to the Vehicle’s keys, or theft by any person related to You by blood, marriage or adoption including wards or foster children; 2) When the keys were left in or on the Vehicle. 3) To any Vehicle that is used for any Commercial Use or emergency services whatsoever; 4) To any vehicle which is not listed in an approved market valuation guide; 5) You fail to report the theft of the Vehicle to the police within 24 hours of Your discovery of the theft; 6) You, or anyone acting on Your behalf, commit any fraudulent act, or falsely swear with regard to any fact or circumstance of a covered loss or claim. Additionally, there is no coverage for any loss resulting directly or indirectly from any dishonest, fraudulent, illegal, or criminal act by You or anyone acting on Your behalf, whether acting alone or in collusion with others; or due to conversion, secretion, or embezzlement by any person in lawful possession of the Vehicle; 7) That occurs outside of the United States or Canada; 8) Due to a fire that is not a direct result of theft; 9) Where You failed to take reasonable precautions against theft (including, but not limited to, leaving keys in Vehicle); and 10) Occurring prior to the Vehicle Protection Product Warranty Purchase Date.
