Page 2 SAC-TIRE-RIM-VSC 08-2020 DEFINITIONS AGREEMENT HOLDER, YOU, YOUR – The purchaser of this Agreement. AGREEMENT – This Tire & Rim Protection Vehicle Service Agreement. Commercial Use - A Commercial Use Vehicle is defined as a vehicle registered to a business and/or for business purposes. Vehicles that are used in excess of manufacturers G.V.W. Vehicles used for construction purposes, delivery purposes, commercial towing, commercial farm operation, tow trucks, snowplows any type of emergency vehicles, volunteer public service(s), motor pool vehicles, rental, taxi cabs, livery or for excessive hauling and pulling are excluded from coverage hereunder. (This does not include rideshare i.e. Uber or Lyft.) DEDUCTIBLE – This Agreement has a $0 deductible. NORMAL WEAR AND TEAR – Wear and Tear is defined as damage to a component that hasn't failed but doesn't meet the manufacturer's tolerances or specifications reduction in operating performance of a Covered Part which exceeds the published tolerances allowed by the manufacturer will be considered Normal Wear and Tear. REPAIR FACILITY – A licensed Repair Facility (licensed as a retail merchant to perform mechanical repairs) authorized by the Administrator to perform repair services under this Agreement. SCHEDULE PAGE – The numbered document which is part of this Agreement where information regarding You, Your Vehicle and coverage options are shown. SERVICE AGREEMENT PROVIDER, WE, US, and OUR (ADMINISTRATOR/OBLIGOR) – means Smart AutoCare, P.O. Box 852770 Richardson, TX 75085 855-292-9309 in all states, except: • FL, LA – Service Agreement Provider – Lyndon Southern Insurance Company, 10751 Deerwood Park Blvd., Ste. 200, Jacksonville, Florida 32256 (800) 888-2738, FL License No. 03698. SELLER – The dealership from whom You purchased this Agreement. TERM – The maximum number of months indicated on the Schedule Page that this Agreement shall be in force. VEHICLE – The Vehicle covered by the terms and conditions of this Agreement as listed on the Schedule Page. COVERAGES A. NEW/USED TIRE AND WHEEL GUARANTEE Flat tire and wheel/rim repair or replacement when tire is damaged beyond repair as a direct result of a: (a) covered road hazard (debris on the road surface such as nails, glass, potholes, rocks, tree limbs or any other object or hazard not normally found in the roadway); (b) damage of tire or rim due to impact with curb or sidewall damage; (c) Cosmetic coverage which includes coverage on curb/road hazard damages that alters the normal appearance of the wheel/rim; (d) tires must have at least 3/32 inch tread depth remaining. Mounting, balancing, valve stem and disposal fees will be covered. Applicable sales tax will be covered. Notice: All "Wheel/rim" repairs will be made on-site at a dealership location utilizing an authorized wheel/rim repair network. Wheels/Rims requiring a remanufacture process due to extensive damage will be sent to a remanufacturing center. Wheels/Rims will be repaired whenever possible; unrepairable wheels/rims will be replaced with like kind and quality of the Vehicle's original wheels/rims. The Repair Network will determine the best repair process for the claim; i.e.: cosmetic (cosmetic coverage will not result in the replacement of a wheel), straightening, remanufacturing or replacement. Chrome/Chrome plated wheels do not qualify for cosmetic coverage. HOW TO FILE A CLAIM (1) Take immediate action to prevent further damage. This Agreement will not cover damage caused by not securing a timely repair of the failed component. (2) If it is dangerous to operate Your Vehicle, or if operating Your Vehicle may cause further damage, You must have the Vehicle towed. (3) Take Your Vehicle to any state licensed Repair Facility. (4) Repair Facility must call the Claim Department at 855-292-9309 for approval prior to the commencement of any repairs. (5) Repair Facility must provide an estimate of parts and labor costs in order to obtain approval. No claim payments will be made if the Claim Department has not issued a claim approval reference number prior to the commencement of any repairs. (6) Photos of damages to tire or wheels along with (Vehicle, VIN plate, DOT, tread depth). (7) You must cooperate in Our investigation of any breakdown. You must allow Us to inspect Your Vehicle if We ask to do so. We have no obligation to inspect Your Vehicle or to certify its condition before or after covered repairs are completed. (8) In-home service is not provided under this Agreement. Any payment of the costs of transporting the Vehicle for service is provided under this Agreement exclusively pursuant to the terms and conditions for emergency road service provided by road club membership services. (9) Reimbursement for emergency repairs performed outside of normal business hours can be obtained by the contract holder only if he/she follows the above procedures on the first business day after such emergency repairs are performed, unless the Agreement Holder shows that it was not reasonably possible to give notice or file the proof of loss within the prescribed time and that the notice was filed as soon as reasonably possible. (10) We would like to contact you regarding the status and progress of your claim via a text message. During your initial claim contact with the Administrator, you will be asked to confirm your acceptance of receiving text messages. You can opt-out of receiving text messages at any time by contacting the Administrator at 855-292-9309 or “Text STOP to end”.
